General Terms and Conditions of Sale of DOGSHOP for the website www.dogshop-france.com.

Products offered for sale on the site are accessories, clothing, toys and food for dogs, decorative items, clothing and fashion accessories for men, women and children.

Article 1. Preamble

These general conditions of sale (hereinafter referred to as “Conditions”) are concluded between;

And on the other hand, people, individuals or not, wishing to make a purchase via the online sales site (Internet)

General Terms and Conditions of Sale of DOGSHOP for the website www.dogshop-france.com hereinafter referred to as “Customers” or the “Customer” individually .

DOGSHOP and Customers together hereinafter referred to as the “Parties”

General Terms and Conditions of Sale of DOGSHOP for the website www.dogshop-france.com hereinafter commonly referred to as the “DOGSHOP Site”

DOGSHOP offers its products exclusively remotely via the Internet (Site or email).

DOGSHOP does not have a store outside of its websites. All products sold by DOGSHOP are listed on the company’s Websites (hereinafter referred to as the “Products”).

The delivery of parcels can only be made territorially in mainland France and certain European countries if available in the choice of delivery countries. For any other country, it is necessary to contact DOGSHOP beforehand.

In the event of an order to a country other than metropolitan France, the Customer is the importer of the Product(s) concerned.

For all Products shipped outside the European Union and DOM-TOM, the price will be calculated excluding taxes automatically on the invoice.

Customs duties or other local taxes or import duties or state taxes may be payable. They will be charged to and are the sole responsibility of the Customer.

DOGSHOP does not distribute a paper catalog.

Article 2. Purpose

These general conditions aim to define the terms of sale between DOGSHOP and its Customers, from the order to the delivery, through the use of the services made available by DOGSHOP and payment.

They regulate all the steps necessary for placing the order and ensure the follow-up of this order between the Parties.

If these should be different depending on the quality of the Client, individual or company, these differences would be clearly mentioned.

Article 3. Scope

These Conditions govern the sale of the Products found on the DOGSHOP Sites on the day the Customer places the order.

They apply to all ordering methods offered by DOGSHOP, whether the order was placed by Internet or by e-mail.

If these Conditions should be different depending on the method of placing the order, these differences will be clearly mentioned.

Article 4. Order taking

Any purchase order signed with the validation click constitutes an irrevocable commitment by the customer which can only be called into question in the case limitedly provided for in this contract in the article “Right of withdrawal”.

Article 5. The order
Capacity to contract:

The purchase of a product found on the sites of the company DOGSHOP not being an act of management of daily life, in view of the respect of article 1124 of the civil code, any customer of the company DOGSHOP declares to have the ability to contract under the conditions described below, i.e. be an emancipated minor or have legal majority and not be protected within the meaning of article 488 of the Civil Code.

DOGSHOP reserves the right to refuse any Order from a Customer with whom a dispute exists or appears during the processing of an Order, in particular a payment dispute.

Acceptance of the Conditions by the Customer:

These Conditions can be read directly on the DOGSHOP website. At the Customer’s request, they can also be sent by e-mail.

The fact for the Customer to tick the box “I have read the general conditions of sale and I accept them” before validating his order automatically entails the express acceptance by him and without restriction or reservation of these Conditions. The Customer acknowledges by this act to have read and understood these Conditions and to accept them.

The purchase by e-mail also implies the acceptance of these Conditions which he acknowledges having previously read, understood and accepted in the conditions mentioned above.

Product Features:

In accordance with Article L 111-1 of the Consumer Code, DOGSHOP strives to present as well as possible, on the technical sheets of the Products, the essential characteristics of the latter of which the Customer must be aware.

DOGSHOP reserves the right to modify the assortment of Products depending in particular on the constraints linked to its suppliers.

The information and characteristics are those given by the suppliers. DOGSHOP is in no way responsible for incorrect data transmitted by suppliers.

The photographs and graphics presented on the sites or in the e-mails sent by DOGSHOP are given for information only. In particular, the difference in perception of shapes and colors between the photographs or graphics presented and the Products cannot engage the responsibility of DOGSHOP.

DOGSHOP will make its best efforts to ensure that the photographic representation of the Products on the DOGSHOP Sites is as faithful as possible. It is nevertheless possible that the perception of the Product(s) does not fully correspond to the Product(s).

Unless otherwise specified on the DOGSHOP Sites, all Products sold by DOGSHOP are new, and comply with the European Community legislation in force and the standards applicable in France.

Refusal of an order:

DOGSHOP reserves the right not to confirm an order for any reason whatsoever, in particular due to either a problem with the supply of products, or a problem concerning the order received.

Price :

The prices of the Products are indicated in euros, all taxes included and excluding shipping costs. They take into account the VAT applicable on the day of the order. Any change in the applicable rate may be passed on to the prices of the Products after the date of entry into force of the new applicable rate.

The VAT rate applied is as a percentage of the value of the goods sold, 20.00% for delivery in Metropolitan France.

These prices are firm and non-revisable during their period of validity but the Seller reserves the right, outside the period of validity, to modify the prices at any time.

The payment requested from the Customer corresponds to the total amount of the purchase, including these costs. An invoice is established by the Seller and given to the Customer upon delivery of the Products ordered.

Shipping fees :

Shipping costs are invoiced to the Customer according to the weight and dimensions of the package, the place of delivery and the carrier.

They are indicated to the Customer before the final registration of the order.

Availability of products:

The vast majority of products on the www.dogshop-france.com site are available and in stock. Stock is kept up to date in real time, based on orders. No orders will be taken for orders that are no longer available in stock. In the event of an error in the stock, the customer will be immediately reimbursed for his order, free of charge, and without any compensation (apart from the full reimbursement of the Order) being able to be claimed by the customer.

Order registration / confirmation :

An e-mail is automatically sent to the Customer to inform him of the registration of his order provided that the e-mail address indicated in the registration form does not contain an error.

Article 6. Payment

Means of payment :
When a Customer is an individual, he can pay for his order:

– Online on the DOGSHOP website by bank or credit card (credit card, Visa card, Eurocard, Mastercard).

Bank transfer to bank account details supplied

– Cheque, the goods will only be sent once the cheque is received and cleared.

Article 7. Delivery

An e-mail is automatically sent to the Customer when the Products are shipped, provided that the e-mail address indicated in the registration form does not contain an error.

Delivery time :

Any order placed (paid for by card or transfer) on the DOGSHOP site will be shipped, for products in stock, within 48 working hours. To this time is added the delivery time. As an indication, this period is 48 hours (Colissimo for France)

Items needed for delivery:

DOGSHOP reminds its customers that:

– The delivery address (which may be different from the billing address) must be exact and mention all the details necessary for a good delivery;

– For delivery by appointment, the Customer must clearly provide a landline and/or mobile phone number at which he can easily be reached;

– For a bulky product delivery, it is the responsibility of the Customer to ensure the conditions of accessibility of the place, floor or delivery room and to inform DOGSHOP or the carrier when taking of appointment.

If the delivery could not be made for reasons of accessibility, DOGSHOP cannot be held responsible.

– An error in the delivery address, place of delivery, accessibility of the place, telephone number for making appointments, absence of the Customer at the scheduled appointment, or any other problem resulting in the need to make a new delivery may be subject to invoicing at the actual costs of the new delivery, the payment of these additional costs alone allowing the new delivery.

In the event of delays, damage, total or partial loss, or any other problem, it is up to the customer to exercise any recourse with the carrier without DOGSHOP’s liability ever being called into question.

Therefore, upon delivery, DOGSHOP recommends that the customer check the condition of the products delivered before signing the acknowledgment of receipt of the package.

If he finds anomalies, he must refuse delivery of the products or issue handwritten, precise and dated reservations. These reservations must be confirmed with the carrier by registered letter with acknowledgment of receipt within three (3) working days of delivery of the products. A copy will be sent to DOGSHOP.

Article 8. Force major

Expressly are considered as cases of force major, in addition to those usually retained by the jurisprudence of French courts and tribunals,

– total or partial strikes, internal or external to the company, blocking of means of transport or supply for any reason whatsoever, governmental or legal restrictions, computer breakdowns, blocking of telecommunications including networks and in particular Internet.

The occurrence of a case of force majeure will initially suspend, automatically, the execution of the order.

If beyond a period of three (3) months, the parties note the persistence of the case of force majeure, the order will be automatically canceled, unless otherwise agreed by both parties.

Article 9. Complaint for non-compliance

Complaints for non-conformity of the product(s) delivered with the order must be made in writing directly to DOGSHOP immediately upon receipt. The customer must keep the packaging and the delivery note.

In the event of an error on the product, the customer undertakes to return the said product or the products concerned within 7 days of their receipt at DOGSHOP on the condition that they are returned without opening their packaging, in their original condition and packaging with accompanying documents.

Upon receipt of the product in good and due form, DOGSHOP will return, at its expense, the product initially ordered.

The customer has, within a period of fourteen days from the delivery of his order, a right of return, at his expense, for exchange or refund, of the products which do not suit him in accordance with article L 121- 20 of the Consumer Code.

If this period expires on a Saturday, Sunday or a public holiday or non-working day, it is extended until the first following working day.

Any return must be the subject of written information from the customer and prior agreement from DOGSHOP.

The returned product must be in its original condition and packaging. It must not have been used, nor have suffered any damage, however minimal, and be in a state of perfect cleanliness.

This right of withdrawal is exercised without penalty, with the exception of return costs.

Within a maximum period of 30 days from receipt of the product, the customer will be reimbursed for the sums paid.

For this purpose, he will communicate to DOGSHOP his bank details.

Any damage observed to a product on return due to a problem with the level of packaging not respected may result in a partial refund or non-refund of the product in the event of impossibility of resale in the state or in the event of aggravation of the problem indicated technique.

Article 11. Warranty
In order to avoid any inconvenience, the products are checked before shipment.

However, the customer benefits from a contractual guarantee against all defects that the product delivered may present for a period of 3 months from delivery, subject to normal use and in accordance with the recommendations set out in the documents relating to the products and manuals attached.

In any case, the products sold benefit from the legal guarantee against hidden defects provided for by articles 1641 and following of the Civil Code.

Finally, some products benefit from an extended warranty. In these cases, the terms and duration of the warranty are specified in the warranty card delivered with the product. This does not cover damage, breakage or malfunctions due to non-compliance with the precautions for use.

For the implementation of the warranty, the customer returns the product to DOGSHOP at his own expense, enclosing the original invoice.

The product will be exchanged for an identical product and sent to the customer at DOGSHOP’s expense, except in the event of out of stock or disappearance of the product from the range offered by DOGSHOP. In the latter case, DOGSHOP will refund the price of the product to the customer.

Article 12. Data protection

As of May 25, 2018, DOGSHOP applies the regulations on the protection of personal data RGPD, we invite you to read our Privacy Policy which is an integral part of our General Conditions of Sale.

The Customer is informed that the collection of his personal data is necessary for the sale of the Products by the Seller as well as their transmission to third parties for the purpose of delivery of the Products. These personal data are collected only for the execution of the sales contract.

The personal data provided by the buyer are necessary for the processing of his order and the establishment of invoices. They may be communicated to the seller’s partners responsible for the execution, processing, management and payment of orders. The buyer has a right of permanent access, modification, rectification and opposition with regard to information concerning him.

Article 13. Electronic signature

The “validation click” constitutes an electronic signature.

This electronic signature has between the parties the same value as a handwritten signature.

Article 14. Evidence

The computerized registers, kept in the computer systems of DOGSHOP under reasonable security conditions will be considered as proof of communication, orders and payments between the parties.

Archiving of purchase orders and invoices is carried out on a reliable and durable medium that can be produced as proof.

Article 15. Intellectual property

DOGSHOP holds the intellectual property rights on the site and the right to distribute the items appearing in the catalog of the electronic store and in particular the photographs for which it has obtained the necessary authorizations from the persons concerned.

Consequently, the partial or total reproduction, on any medium whatsoever, of the elements making up the site and the catalogue, their use and their provision to third parties are strictly prohibited.

Anyone with a website wishing to place a simple link on their site directly to the DOGSHOP site must request authorization from DOGSHOP.

An authorization given by DOGSHOP will in no way constitute an implicit affiliation agreement and will in no case be given definitively.

Upon simple request from DOGSHOP, this link must be removed.

Any hypertext link to the www.dogshop-france site and using “framing” or “in-line linking” type techniques is strictly prohibited.

Article 16. Entirety of the contract and nullity

A change in legislation, regulation or a court decision rendering one or more clauses of these General Conditions of Sale null and void shall not affect the validity of these General Conditions of Sale.

Such a change or observation could in no way allow the Customer not to respect these General Conditions of Sale.

If a condition was not explicitly mentioned, it would be considered to be governed by the practices in force in the distance selling sector whose companies are headquartered in France.

Article 17. Non-waiver

The fact that DOGSHOP does not take advantage of a breach by the customer of any of its obligations could not be interpreted as a waiver of the obligation concerned and to take advantage of this breach later.

Article 18. Applicable Laws and Settlement of Disputes

This contract is subject to French law, both for the rules of substance and for the rules of form.

The site reserves the right to initiate criminal proceedings against any attempted fraudulent purchase or purchase with a prohibited or opposed, stolen or falsified bank card. In this context, no attempt at amicable conciliation will be accepted.

The fact that a clause of these General Conditions of Sale becomes null and void cannot call into question the validity of the other stipulations and does not exonerate the Customer from the performance of his contractual obligations.

IN THE EVENT OF A DISPUTE AND IN THE ABSENCE OF AMICABLE AGREEMENT BETWEEN THE PARTIES, JURISDICTION IS EXPRESSLY ATTRIBUTED TO THE COURTS WITHIN THE JURISDICTION OF THE HEAD OFFICE OF DOGSHOP, NOT OBSTANTING APPEAL IN GUARANTEE OR MULTIPLE DEFENDANTS, EVEN FOR EMERGENCY PROCEDURES OR PROCEDURES CONSERVATORY IN REFERENCE OR BY REQUEST

Article 19. Duration and application

These Conditions apply to all purchases made on the www.dogshop-france.com  website. These Conditions may be modified at any time by DOGSHOP. The applicable Conditions are those in force on the date of registration of the order.
